Understanding Overstay Absconding in the UAE – Rules, Penalties, and Solutions

Living or working in the UAE comes with clear legal responsibilities, especially when it comes to visa validity and employment regulations. Two of the most serious violations that expatriates should be aware of are overstay absconding, which can result in fines, travel bans, and legal consequences if not handled properly.

Overstaying occurs when a resident or visitor remains in the country after their visa or grace period has expired. Even a short delay in renewal can lead to daily penalties, starting from AED 50 per day, depending on the visa type. These fines accumulate quickly, making it crucial to renew your visa or exit the country on time.

On the other hand, absconding refers to a situation where an employee leaves their job without officially cancelling their employment visa or notifying their employer. This is a serious offense under UAE labour laws, as it disrupts the sponsorship system. Employers are required to report such cases to the Ministry of Human Resources and Emiratisation (MOHRE), leading to legal restrictions on the employee’s visa status and possible entry bans.

However, there are legal ways to resolve these issues. The UAE government provides several channels through which residents can regularize their status. By visiting authorized typing centers, Amer Centers, or the General Directorate of Residency and Foreigners Affairs (GDRFA), individuals can check their current visa status and seek guidance on how to lift bans or pay fines.

In certain cases, if the absconding report was filed unfairly or due to misunderstanding, residents can appeal and clear their record by providing evidence such as employment termination letters or complaint reports.
